I don't think it's "overwhelmed" by the first clause, I simply don't think it applies in the manner you think it does.<BR/><BR/>I think the 14th (assuming arguendo the application of the BOR to the states) Amendment's relevant clause is slightly different from what you cite, but it's been a while since I've looked.
